This confirmation of receipt does not yet constitute acceptance of the contract.<\/p><p class=\"isSelectedEnd\">(4) The contract is only concluded by:<\/p><ul data-spread=\"false\"><li><p class=\"isSelectedEnd\">an express order confirmation or<\/p><\/li><li><p class=\"isSelectedEnd\">the dispatch of the goods<\/p><\/li><\/ul><p class=\"isSelectedEnd\">(5) The text of the contract is stored by the seller. Any payments already made will be refunded.<\/p><p class=\"isSelectedEnd\">(4) Partial deliveries are permitted, provided they are reasonable for the customer.<\/p><p class=\"isSelectedEnd\">(5) For consumers, the risk of accidental loss of the goods shall not pass to the customer until the goods are handed over.<\/p><p class=\"isSelectedEnd\">(6) For businesses, the risk shall pass to the transport company upon handover.<\/p><p>(7) For deliveries outside the EU, additional customs duties and taxes may apply, which are to be borne by the class=\"isSelectedEnd\">Consumers are entitled to a statutory right of return.<\/p><p>The cancellation policy and the cancellation form are provided to the customer separately during the ordering class=\"isSelectedEnd\">Wear parts<\/p><\/li><\/ul><p class=\"isSelectedEnd\">(4) The customer shall bear the costs of the return shipment, unless otherwise agreed.<\/p><p>(5) The statutory right of return remains unaffected by this.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-49eb766 elementor-widget elementor-widget-text-editor\" data-id=\"49eb766\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h2>\u00a7 7 Warranty (Liability for defects)<\/h2><p class=\"isSelectedEnd\">(1) The statutory warranty rights apply.<\/p><p class=\"isSelectedEnd\">(2) For consumers, the warranty period is 24 months from receipt of the goods.<\/p><p>(3) For businesses, the warranty period is 12 months.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-61e5c62 elementor-widget elementor-widget-text-editor\" data-id=\"61e5c62\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h2>\u00a7 8 Warranty Terms (Voluntary Warranty)<\/h2><p class=\"isSelectedEnd\">(1) The seller also provides a voluntary 5-year warranty on woodwind and brass instruments.<\/p><p class=\"isSelectedEnd\">(2) The warranty applies exclusively to material and manufacturing defects.<\/p><p class=\"isSelectedEnd\">(3) The following are excluded from the warranty:<\/p><ul data-spread=\"false\"><li><p class=\"isSelectedEnd\">Wear parts<\/p><\/li><li><p class=\"isSelectedEnd\">Damage caused by improper use<\/p><\/li><li><p class=\"isSelectedEnd\">Damage caused by lack of care<\/p><\/li><li><p class=\"isSelectedEnd\">External influences (e.g. dropping, moisture)<\/p><\/li><li><p class=\"isSelectedEnd\">Accessories and consumables<\/p><\/li><\/ul><p class=\"isSelectedEnd\">(4) The following conditions must be met to claim under the warranty:<\/p><ul data-spread=\"false\"><li><p class=\"isSelectedEnd\">Presentation of the proof of purchase<\/p><\/li><li><p class=\"isSelectedEnd\">Proper use of the instrument<\/p><\/li><\/ul><p class=\"isSelectedEnd\">(5) The warranty shall be fulfilled, at the seller\u2019s discretion, by:<\/p><ul data-spread=\"false\"><li><p class=\"isSelectedEnd\">Repair or<\/p><\/li><li><p class=\"isSelectedEnd\">Replacement<\/p><\/li><\/ul><p class=\"isSelectedEnd\">(6) The warranty applies within the European Union.<\/p><p>(7) Statutory warranty rights remain unaffected.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5e315c9 elementor-widget elementor-widget-text-editor\" data-id=\"5e315c9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h2>\u00a7 9 Retention of title<\/h2><p>The goods remain the property of the seller until full payment has been made.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7f77afc elementor-widget elementor-widget-text-editor\" data-id=\"7f77afc\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h2>\u00a7 10 Liability<\/h2><p class=\"isSelectedEnd\">(1) The seller shall be liable without limitation:<\/p><ul data-spread=\"false\"><li><p class=\"isSelectedEnd\">in cases of wilful misconduct and gross negligence<\/p><\/li><li><p class=\"isSelectedEnd\">in cases of injury to life, limb or health<\/p><\/li><\/ul><p class=\"isSelectedEnd\">(2) In cases of slight negligence, the seller shall only be liable for breaches of material contractual obligations (cardinal obligations).<\/p><p>(3) In such cases, liability is limited to foreseeable, typical damage.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-99b6aad elementor-widget elementor-widget-text-editor\" data-id=\"99b6aad\" resolution<\/h2><p class=\"isSelectedEnd\">(1) The European Commission provides an online dispute resolution platform:<br \/><a href=\"https:\/\/ec.europa.eu\/consumers\/odr\/\">https:\/\/ec.europa.eu\/consumers\/odr\/<\/a><\/p><p>(2) The seller is neither obliged nor willing to participate in any dispute resolution proceedings.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ef6311b elementor-widget elementor-widget-text-editor\" data-id=\"ef6311b\" provisions<\/h2><p class=\"isSelectedEnd\">(1) The law of the Federal Republic of Germany shall apply, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.<\/p><p class=\"isSelectedEnd\">(2) If the customer is a trader, a legal entity under public law or a special fund under public law, the place of jurisdiction shall be the seller\u2019s registered office.<\/p><p>(3) Should any provision of these General Terms and Conditions be invalid, this shall not affect the validity of the remaining provisions.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4c490f9 elementor-widget elementor-widget-text-editor\" data-id=\"4c490f9\" Instrumenten nach Reparatur, Wartung oder General\u00fcberholung<\/h2><p>\u00a7 10 Lagerung von Instrumenten nach Reparatur, Wartung oder General\u00fcberholung<\/p><p>(1) Der Kunde wird nach Fertigstellung einer Reparatur, Wartung oder General\u00fcberholung \u00fcber die Abholbereitschaft des Instruments informiert.<\/p><p>(2) Wird das Instrument nicht innerhalb von 20 Kalendertagen nach erfolgter Benachrichtigung abgeholt, ist die Musikinstrumente Freyer GmbH berechtigt, ab dem 21. Kalendertag Lagerkosten in H\u00f6he von **1 % des Rechnungsbetrages je angefangenen Kalendertag**, mindestens jedoch **3,00 \u20ac je Kalendertag**, zu berechnen.<\/p><p>(3) Bis zur vollst\u00e4ndigen Begleichung s\u00e4mtlicher Forderungen aus dem jeweiligen Auftrag steht der Musikinstrumente Freyer GmbH das gesetzliche Unternehmerpfandrecht zu.
