§ 1 Scope
(1) These General Terms and Conditions (GTC) apply to all orders placed by consumers and businesses (hereinafter referred to as the “Customer”) via the Seller’s online shop.
(2) A consumer within the meaning of Section 13 of the German Civil Code (BGB) is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their self-employed professional activity.
(3) An entrepreneur within the meaning of Section 14 of the German Civil Code (BGB) is a natural or legal person or a partnership with legal capacity.
(4) Any deviating terms and conditions of the Customer shall not be recognised unless the Seller expressly agrees to their validity.
§ 2 Conclusion of the contract
(1) The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalogue.
(2) By clicking the “Buy” button, the customer places a binding order for the goods contained in the shopping basket.
(3) The seller will confirm receipt of the order by email. This confirmation of receipt does not yet constitute acceptance of the contract.
(4) The contract is only concluded by:
an express order confirmation or
the dispatch of the goods
(5) The text of the contract is stored by the seller. The order details and these General Terms and Conditions are sent to the customer by email.
(6) The contract language is German.
§ 3 Prices and Terms of Payment
(1) All prices are quoted in euros and include VAT at the statutory rate.
(2) Any additional delivery charges will be clearly displayed during the ordering process.
(3) The following payment methods are available:
Prepayment
PayPal
Credit card
Sofortüberweisung (if offered)
(4) The purchase price is due immediately upon conclusion of the contract.
(5) In the event of late payment, the seller reserves the right to charge interest on arrears at the statutory rate.
§ 4 Delivery and shipping
(1) Delivery shall be made to the delivery address provided by the customer.
(2) The delivery time within Germany is usually 2–5 working days, unless otherwise stated.
(3) Should a product be unavailable, the customer will be informed immediately. Any payments already made will be refunded.
(4) Partial deliveries are permitted, provided they are reasonable for the customer.
(5) For consumers, the risk of accidental loss of the goods shall not pass to the customer until the goods are handed over.
(6) For businesses, the risk shall pass to the transport company upon handover.
(7) For deliveries outside the EU, additional customs duties and taxes may apply, which are to be borne by the customer.
§ 5 Returns Policy
Consumers are entitled to a statutory right of return.
The cancellation policy and the cancellation form are provided to the customer separately during the ordering process.
§ 6 Voluntary 30-day return policy
(1) In addition to the statutory right of return, the seller grants a voluntary right of return for a period of 30 days from receipt of the goods.
(2) The following conditions apply:
unused goods
in perfect condition
complete set of accessories
(3) The following are excluded from the right of return:
custom-made items
Hygiene items (e.g. mouthpieces, reeds once used)
Wear parts
(4) The customer shall bear the costs of the return shipment, unless otherwise agreed.
(5) The statutory right of return remains unaffected by this.
§ 7 Warranty (Liability for defects)
(1) The statutory warranty rights apply.
(2) For consumers, the warranty period is 24 months from receipt of the goods.
(3) For businesses, the warranty period is 12 months.
§ 8 Warranty Terms (Voluntary Warranty)
(1) The seller also provides a voluntary 5-year warranty on woodwind and brass instruments.
(2) The warranty applies exclusively to material and manufacturing defects.
(3) The following are excluded from the warranty:
Wear parts
Damage caused by improper use
Damage caused by lack of care
External influences (e.g. dropping, moisture)
Accessories and consumables
(4) The following conditions must be met to claim under the warranty:
Presentation of the proof of purchase
Proper use of the instrument
(5) The warranty shall be fulfilled, at the seller’s discretion, by:
Repair or
Replacement
(6) The warranty applies within the European Union.
(7) Statutory warranty rights remain unaffected.
§ 9 Retention of title
The goods remain the property of the seller until full payment has been made.
§ 10 Liability
(1) The seller shall be liable without limitation:
in cases of wilful misconduct and gross negligence
in cases of injury to life, limb or health
(2) In cases of slight negligence, the seller shall only be liable for breaches of material contractual obligations (cardinal obligations).
(3) In such cases, liability is limited to foreseeable, typical damage.
§ 11 Dispute resolution
(1) The European Commission provides an online dispute resolution platform:

(2) The seller is neither obliged nor willing to participate in any dispute resolution proceedings.
§ 12 Final provisions
(1) The law of the Federal Republic of Germany shall apply, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
(2) If the customer is a trader, a legal entity under public law or a special fund under public law, the place of jurisdiction shall be the seller’s registered office.
(3) Should any provision of these General Terms and Conditions be invalid, this shall not affect the validity of the remaining provisions.

(1) Der Kunde wird nach Fertigstellung einer Reparatur, Wartung oder Generalüberholung über die Abholbereitschaft des Instruments informiert.
(2) Wird das Instrument nicht innerhalb von 20 Kalendertagen nach erfolgter Benachrichtigung abgeholt, ist die Musikinstrumente Freyer GmbH berechtigt, ab dem 21. Kalendertag Lagerkosten in Höhe von **1 % des Rechnungsbetrages je angefangenen Kalendertag**, mindestens jedoch **3,00 € je Kalendertag**, zu berechnen.
(3) Bis zur vollständigen Begleichung sämtlicher Forderungen aus dem jeweiligen Auftrag steht der Musikinstrumente Freyer GmbH das gesetzliche Unternehmerpfandrecht zu. Die Verwertung des Pfandrechts richtet sich nach den gesetzlichen Vorschriften.
(4) Dem Kunden bleibt der Nachweis vorbehalten, dass kein oder ein wesentlich geringerer Aufwand entstanden ist.
